INFORMATION ABOUT FAIR PROCESSING OF PERSONAL DATA

I, Surgeon Dr Esra Bilgen resident at the address of Harbiye Mah. Mim Kemal Öke Cad. Melek Ap. No.19 Interior Door No. 2 Şişli/Istanbul and registered at the Istanbul Beyoğlu Tax Administration with the tax number 9410291776, attach great importance to patient privacy  and the preservation of all kinds of personal data belonging to our patients in the best possible way and with the utmost care. Your personal data may be processed by ESRA BİLGEN (The Clinic) in the capacity of “data controller” within the scope of the Law on the Protection of Personal Data with No. 6698 (“KVKK”) and relevant legal legislation within the scope and framework described hereinbelow. The Clinic prepared the Information About the Fair Processing of Personal Data, (“Information Text”) in compliance with the “Obligation of Data Controller to Inform” referred to in Article 10 of the KVKK, to inform you most transparently about the identity of the data controller, the method and legal purpose of collection of your personal data, for what purpose this data will be processed, to whom and for what purpose it can be transferred, and your rights listed in Article 11 of the KVKK. 1. The Method and Legal Purpose for the Collection of Your Personal Data

According to the KVKK, personal data is any kind of information related to a certain or identifiable real person. Your private and general personal data, notably your personal health data are collected concerning the health services provided to you for the below-given purposes, according to the health care legislation, and related secondary legislation in compliance with KVKK; either orally, in writing, or electronically by our clinic. Your personal data collected by physical and/or electronic methods are collected for purposes such as their collection is clearly stipulated by Article 5 of the KVKK; when such data is mandatory to protect the life or physical integrity of any person who is unable to express his/her consent due to actual impossibility or whose consent is not given legal validity, and the others; the formation or performance of a contract; fulfilment of any legal obligation; the disclosure of the data by relevant person and creation, usage and protection of a right; when the legitimate interests of the clinic require the collection of such data providing that fundamental rights and freedom of the related person is not endangered; and due to the legal purposes as given in Article 6 of KVKK such as the protection of public health, preventive medicine, medical diagnosis, treatment and care services, planning and management of the health services and their financing.

2. Processing Personal Data and the Purposes of Processing

Your personal data obtained within the framework described above are as follows;

Your personal data, including your private personal data can be processed for the below-given purposes;

• Protection of public health,
• Carrying out preventive medicine, medical diagnostics, treatment and care services,
• Planning and management of health services and financing thereof,
• Informing about your appointments,
• Planning and management of clinical functioning,
• Conducting of all Human Resources processes and policies of the clinic
• Conducting analysis for the purpose of improving health services,
• Prevention of misconduct and unauthorized transactions,
• Ensuring risk management and quality improvement actions,
• Ability to share promotional content and messages through the website and mobile channels,
• Conducting research,
• Conducting the advertising/campaign /promotion processes,
• Fulfillment of legal and regulatory requirements,
• Invoicing in exchange for performed health services,
• Identity confirmation,
• Sharing of the requested information with the Ministry of Health and other public institutions and organizations in accordance with the relevant legislation,
• Sharing of information requested with private insurance companies within the scope of financing of health services,
• By providing communication with the hospital in order for the operation to be performed at the contracted hospital; informing the anesthesia and the staff who will be present during the operation to perform your care services and surgery,
• To be able to answer all kinds of questions and complaints related to our health services,
• Taking the necessary technical and administrative measures to ensure data security,
• Analyzing your use of health services and retaining your health data to enhance and improve health services,
• Maintaining information about your health data that must be stored in compliance with the relevant legislation,
• Conducting auditing and/or regulatory tasks to be performed by designated and authorized public institutions and organizations, as well as professional organizations that are public institutions,
• Fulfilment of requests for information and documents requested by judicial bodies and/or administrative authorities,
• To be able to reach a financial agreement regarding the health services provided to you with the institutions we are contracted with,
• Compliance with the policies and procedures of organizations that are in a business relationship with the clinic,
• Conducting clinical emergency processes; conducting and developing medical diagnostics, treatment and care services, including, but not limited to, measuring patient satisfaction,
• Increasing patient satisfaction.

Your above-listed personal data may be processed within the scope of the below given and other legislation including but not limited to the following: The Basic Law of Health Services with no 3359, Decree on the organization and duties of Ministry of Health and affiliated Agencies with no 663, Regulation of Private Hospitals, Code of Private Hospitals, Regulation of Emergency Medical Services, Operational Regulation of Inpatient Treatment Institutions, Processing and Protection of Personal Health Data, Regulations of the Ministry of Health and may be transferred to the archives and information systems of the clinic, and retained both digitally and physically. It is your responsibility to inform your family members about the personal data belonging to your family members that you will share with us and obtain their explicit consent if necessary.

3. Transferring Your Personal Data

Your personal data processed by us within the scope of KVKK and other relevant legislation may be shared with the Ministry of Health within the framework of national and international legislation, Provincial-District Health Departments and the affiliated sub-departments, family medicine centers, private insurance companies, the Social Security Institution, the General Directorate of Security and the relevant law enforcement authorities, the General Directorate of Population, Turkey Pharmacists Association, judicial authorities, our contracted laboratories for medical diagnosis, medical centers, and other third-party health care service providers, health institutions to where the patient is referred or the patient applied, the physicians who may perform your surgery outside of the clinic at our contracted hospitals; your authorized representatives, the institutions you are a member of and/or you are currently working, lawyers, tax consultants and auditors, and any third parties we receive counseling, regulatory authorities and supervisory agencies and legal authorities, our service providers we receive services from and the parties who give collaborative support and with our business partners within the country and/or abroad to give  information to any authorized persons, institutions and organizations;  to secure the safety of clinical operations; to conduct the audit and investigation activities; to make the operational management efficient within the clinic; taking risk management and quality improvement actions; confirming your relation with our clinic and our contracted organizations and conducting emergency incidents in compliance with Article 8 and 9 of KVKK.

4. What are your rights within the scope of Article 11 of KVKK?

• Learning whether your personal data has been processed,
• Requesting information if your personal data has been processed,
• Learning the purpose of processing personal data and whether they are used in accordance with their purpose,
• Knowing the third parties to whom your personal data has been transferred domestically or abroad,
• Requesting correction of your personal data if it is incomplete or incorrectly processed, and request notification of the process performed in this context to the third parties to whom your personal data has been transferred,
• Although it has been processed in accordance with the KVKK and other relevant provisions of the law, in the event that the reasons for its processing disappear, requesting the deletion or destruction of your personal data within the framework of the conditions stipulated in the legislation and that the transaction made in this context be notified to the third parties to whom your personal data has been transferred,
• Objection to the result in case of a result against you arises by analyzing the processed data exclusively through automated systems,
• Requesting the remedy of this damage if you suffer damage due to illegal processing of personal data.

Your request will be finalized free of charge as soon as possible and not later than thirty days.

If the transaction subject to your request requires an additional cost, you may be charged according to the tariff determined by the Personal Data Protection Board.
